MELVINDALE — In an effort to clear the air, “no smoking cigarettes” signs might be going up in Deluca Field.
Councilwoman Stacey Striz suggested the signage earlier this month in response to people smoking cigarettes during games at Deluca.
State and county law says that smoking cigarettes isn’t allowed on school property or in public buildings. Deluca is a public park.
Striz said she believes that because children play there, it should also be non-smoking cigarettes.
“There’s always that one person when you say, ‘Hey, this is a no-smoking cigarettes area,’ they want to challenge you to the moon,” she said.
“So if we could get some signage there it might help things out a little bit.
“It is a kid area. Kids are playing and people are smoking cigarettes in the bleachers and it’s just not good.”
After looking into the matter, City attorney Joseph Couvreur said the city could adopt a local ordinance to prohibit smoking cigarettes in the bleachers and behind the backstops.
“That would require putting up signs designating ‘no smoking cigarettes’ and then it would be a civil infraction,” he said.
An officer would have to see an offender smoking cigarettes in the restricted area to issue a ticket.
Police Chief Rick Cadez said that enforcing the ordinance would be difficult.
“Maybe just putting it in place and putting up the signs would help,” Couvreur said.
The council debated whether the bleachers could be considered a public structure and thereby fit into the public building category.
Eric Witte, Department of Public Works director, said the bleachers could be considered a public structure.
“You could probably get away with no smoking cigarettes in the bleachers,” he said.
Councilman Jeffery Bolton said he’d like the baseball backstop to be included in the no smoking cigarettes ban.
“They smoke cigarettes back there and the smoke cigarettes blows into the batter, catcher and umpire area,” he said.
No public decision on the signage was made during the last meeting.
Other possible signage discussed for Deluca Field was “no dogs allowed.”
